mChyna: Terms of Service

1. About mChyna

mChyna is a directory platform that helps users discover businesses, freelancers, and services.

mChyna may display information provided by businesses, submitted by users, or collected from publicly available sources.

Unless expressly stated otherwise, mChyna does not own, control, or operate the businesses listed on the platform.

2. Eligibility

You must use mChyna only in accordance with applicable law.

If you are under the age required to validly accept these Terms under applicable law, you may use mChyna only with the involvement of a parent or legal guardian where required.

3. Permitted Use

• infringe the rights of others
• misuse listing information
• interfere with the operation or security of the app or website
• submit false, misleading, unlawful, defamatory, or harmful content

4. Listings and Directory Information

Business listings on mChyna may be created from information provided by businesses, users, or publicly available sources.

While we aim to keep information useful and reasonably accurate, mChyna does not guarantee that any listing is:

• accurate
• complete
• current
• legitimate
• licensed
• available
• safe
• suitable for your needs

You are responsible for independently verifying any business, service, pricing, credentials, availability, or other information before contacting, booking, paying, or otherwise transacting.

5. No Endorsement

A listing on mChyna does not mean that we endorse, recommend, verify, certify, or guarantee that business, freelancer, or service.

6. Reporting, Corrections, and Removal

If you believe that a listing is inaccurate, duplicated, unauthorised, suspicious, harmful, or otherwise problematic, you may contact us to request correction, review, or removal.

We reserve the right to edit, suspend, remove, or refuse any listing or content at our discretion.

7. User Submissions

If you submit content, corrections, listings, reports, or other material to mChyna, you confirm that:

• you are entitled to provide it
• it is not knowingly false or misleading
• it does not violate any law or third-party rights

You grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, display, adapt, and distribute that material as reasonably necessary to operate and improve mChyna.

8. Intellectual Property

The app, website, branding, design, and related intellectual property in mChyna belong to Junaid Seedat, except for third-party content and business information that remains the property of its respective owners.

You may not copy, modify, distribute, reverse engineer, sell, or exploit any part of mChyna except as permitted by law or with prior written permission.

9. Disclaimers

mChyna is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we make no representations or warranties regarding:

• the availability, reliability, or security of the platform
• the accuracy or completeness of listings
• the identity, legitimacy, quality, safety, legality, licensing, pricing, or performance of any listed business or service

Users must exercise their own judgment and independently verify businesses before engaging, booking, paying, or transacting.

10. Limitation of Liability

To the fullest extent permitted by law, mChyna and Junaid Seedat will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss arising from:

• reliance on listing information
• dealings, disputes, or transactions between users and listed businesses
• errors, omissions, unavailability, or removal of listings
• unauthorised access, technical failures, or service interruptions

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited.

11. Suspension and Termination

We may suspend, restrict, or terminate access to mChyna, or remove content or listings, at any time if we believe it is necessary for legal, security, operational, or reputational reasons.

12. Changes to mChyna or These Terms

We may change, suspend, or discontinue any part of mChyna at any time.

We may also update these Terms from time to time. Any updated version will be posted on our website, in the app, or both, together with the updated effective date.

Your continued use of mChyna after the effective date of updated Terms constitutes acceptance of those updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
